Terms of Use

Note: This is an English translation of the German original (AGB) for your convenience. In case of inconsistencies, the German version prevails. The operator is based in Germany; German law applies.

1. Scope and Provider

These Terms of Use ("Terms") govern the use of the website zug-ticket-kaufen.de ("Website") in the relationship between the provider and the users ("you" or "User").

The provider is Ivan Pervushin, Marxstr. 10b, 45527 Hattingen, Germany (sole proprietorship). Full contact details are available in the Imprint.

Conflicting or deviating terms of the User shall only be accepted if and to the extent that the provider expressly agrees to them in writing.

2. Services Provided

The Website is an independent information portal about train travel in Germany and Europe. We provide schedule information, connection and route data, guides, live delay data, price comparisons, a CO₂ calculator as well as overviews of trains and stations.

We are neither a tour operator, travel agent nor ticket vendor within the meaning of the package travel law. We do not sell tickets and do not enter into any transportation or booking contracts with users.

We reserve the right to extend, change or discontinue offered features at any time, to the extent this is reasonable for the User.

3. Affiliate Referrals to Third Parties

The Website contains links to external booking and comparison portals ("Third Parties") through which tickets, hotel accommodation and other travel services can be booked. These currently include in particular:

  • Omio (Omio GmbH) – rail/bus/flight ticket comparison
  • Trainline (Trainline.com Ltd.) – train tickets
  • FlixBus / FlixTrain (Flix SE) – bus and train tickets
  • ÖBB Nightjet (ÖBB-Personenverkehr AG) – night train tickets
  • Stay22 (Stay22 Inc.) – hotel comparison via Booking.com, Expedia etc.

By clicking such a link you will be redirected to the Third Party's website. The booking and transportation contract is concluded exclusively between you and the respective Third Party – not with us. The Third Party's terms and privacy notices apply to the contractual relationship with the Third Party.

We receive an affiliate commission from the Third Party for successfully referred bookings. There are no additional costs for you compared to booking directly with the Third Party. Affiliate links are transparently labelled.

We have no influence on pricing, availability, booking processing, payment handling or customer service of the Third Parties. For complaints, cancellations or claims arising from bookings please contact the respective Third Party directly.

4. Use of the Website

Use of the Website is free of charge and generally does not require registration. Individual features (e.g. posting comments) may require you to provide a name and other information.

You agree to use the Website only within the framework of applicable law and these Terms. Automated queries to an abusive extent (e.g. scraping in a way that disrupts operation), circumvention of security measures and the use of content for competing commercial offers without our consent are prohibited.

5. User Comments and Content

5.1 Minimum Age

Users submitting comments, delay reports or other content must be at least 18 years old or have the express consent of a legal guardian.

5.2 Permitted Content

Permitted are factual contributions on the topic of the respective page, in particular: experience reports, delay reports with date and duration, information on connections, questions about trains and connections as well as constructive discussions.

5.3 Prohibited Content

Not permitted are in particular:

  • Content that infringes third-party rights (e.g. copyright, trademark, personality rights)
  • Insults, hate speech, discrimination, threats, bullying
  • Illegal content (e.g. incitement, extremism, glorification of violence)
  • Personal data of third parties without their consent
  • Advertising, spam, affiliate links, phishing, malware
  • Misleading or intentionally false information (e.g. fabricated delays)
  • Off-topic content unrelated to the respective page

5.4 Licence

By submitting a contribution, you grant us a simple, free of charge, temporally and geographically unlimited, revocable licence to display, store, archive, process for moderation purposes and link to your contribution on the Website. Revocation occurs by deletion request to contact@zug-ticket-kaufen.de or via the contact form. Existing copies held by third parties (e.g. search engine caches) are not covered by the revocation; deletion is limited to our systems.

5.5 Moderation

We are entitled to check submitted content prior to publication (pre-moderation) or to remove it subsequently if it violates these Terms or applicable law. We are not obliged to publish content and may reject or withdraw publication without stating reasons.

5.6 Responsibility for Own Content

You bear full responsibility for the content you submit (Section 7 (1) German TMG). You indemnify us against all claims by third parties arising from a culpably unlawful breach of these Terms by you, including reasonable costs of legal defence.

6. Notice & Takedown

Should you come across unlawful content on the Website – for example content that violates your rights or the rights of third parties – we ask for a report to contact@zug-ticket-kaufen.de with the following information:

  • URL of the page in question
  • The content objected to (quote, screenshot)
  • Description of the legal violation
  • Your contact details for queries

We examine every substantiated report promptly and remove or block content without delay where a legal violation is obvious (Section 10 German TMG).

7. Disclaimer for Information on the Website

We prepare our content with utmost care and from reliable sources. Nevertheless, we point out the following limitations:

  • Schedule and live data originate among other sources from Deutsche Bahn AG (HAFAS), GTFS feeds of European railways as well as other third-party sources. We give no warranty for the accuracy, completeness or timeliness of this data. Delays, cancellations and platform changes are retrieved in real time but may be technically delayed or erroneous.
  • Price information are estimates and reference values. The final price is determined exclusively by the respective Third Party at the time of booking.
  • CO₂ calculations are based on average values and serve only rough orientation.
  • User comments reflect solely the personal opinion of users and are not substantively reviewed by us.

Limitation of liability: We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. In the case of slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract. Any further liability is excluded. Mandatory statutory liability (e.g. under the Product Liability Act) remains unaffected.

8. Copyright

All content created by us (texts, graphics, logos, data visualisations, code) is protected by copyright. Any reproduction, editing, distribution or exploitation outside the narrow limits of copyright requires our prior written consent.

Insofar as content on this Website does not originate from us (e.g. OpenStreetMap map data, Wikipedia quotations, third-party images), it is used with source attribution and under the respective applicable licence.

Private downloading, printing and sharing of individual pages via social media channels for private, non-commercial use is permitted.

9. Installation as Progressive Web App (PWA)

The Website can be installed as a Progressive Web App on compatible devices. This is done exclusively via browser functions (e.g. "Add to Home Screen") without installing a native app from an app store. No additional contracts arise from this; the same Terms apply.

10. Changes to these Terms

We reserve the right to adapt these Terms with effect for the future if this becomes necessary for material reasons (e.g. new features, legal changes, supreme court rulings). The current version is available on this page and marked with the revision date.

As the use of the Website is not tied to registration, information about changes is provided by updating this page. By continuing to use the Website after changes, the amended Terms are deemed accepted, provided they are reasonable for the User.

11. Applicable Law and Jurisdiction

These Terms and the usage relationship are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers domiciled in the European Union, the mandatory consumer protection law of the country of residence remains unaffected.

The exclusive place of jurisdiction for all disputes arising from or in connection with this use is, to the extent legally permissible, Hattingen, Germany. For consumers, the statutory place of jurisdiction applies.

12. Consumer Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) which you can find at https://ec.europa.eu/consumers/odr/ .

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body within the meaning of the German Consumer Dispute Resolution Act (VSBG).

13. Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the legally permissible regulation shall apply which comes closest economically to the purpose pursued by the invalid provision.
